Terms and conditions for participating in the GhostShorts Ambassador Program
By applying to, participating in, or submitting content under the GhostShorts Ambassador Program (the "Program"), you ("Ambassador," "you") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and GhostShorts ("GhostShorts," "we," "us," "our"), operated by GhostShorts Inc.
You are an independent contractor. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship between you and GhostShorts. You are not authorized to make any representations, commitments, or promises on behalf of GhostShorts. You will not hold yourself out as an employee, agent, or representative of GhostShorts.
You are solely responsible for your own taxes, insurance, and compliance with all applicable laws in your jurisdiction. GhostShorts does not withhold taxes, provide benefits, or issue tax forms unless required by law.
Participation in the Program is by application only. Submitting an application does not guarantee acceptance. GhostShorts reserves the sole and absolute right to accept or reject any application for any reason or no reason at all, at our sole discretion, without explanation.
Accepted Ambassadors may be removed from the Program at any time, for any reason or no reason, at GhostShorts' sole discretion, with or without notice.
GhostShorts may modify, suspend, or terminate the Program in whole or in part at any time, for any reason, at our sole discretion. This includes but is not limited to changes in:
We will make reasonable efforts to provide 7 days notice for rate changes to active Ambassadors, but this is a courtesy, not an obligation. Changes take effect immediately unless otherwise stated. Continued participation after changes constitutes acceptance of the updated Terms.
If the Program is terminated entirely, GhostShorts will make reasonable efforts to pay out earnings for posts already within their measurement window at the time of termination, but this is not guaranteed.
Ambassadors acknowledge that the Program may be discontinued at any time and that participation does not create any expectation of future earnings, continued availability, or ongoing relationship with GhostShorts. You should not rely on Program income as a primary or guaranteed source of revenue.
GhostShorts is the sole and final arbiter of whether any post qualifies for payment under the Program. This includes but is not limited to determinations about:
Definition of "organic impressions": Impressions that occur naturally without paid promotion, coordinated engagement (e.g., engagement pods, follow-for-follow schemes, group DM chains), or artificial amplification of any kind (e.g., bots, view-buying services, automated tools). If impressions are generated by any means other than genuine audience reach, they are not organic.
All eligibility decisions are final and non-negotiable. GhostShorts is under no obligation to explain, justify, or appeal any eligibility determination. If we determine that a post does not qualify, it does not qualify. Period.
Posting Limits: Ambassadors are limited to a maximum of 2 qualifying posts per calendar month, across all platforms combined. This is a global cap, not a per-platform cap. A minimum of 7 days must elapse between qualifying posts. Posts submitted in excess of these limits will not be eligible for payment. Repeated violations of posting limits may result in removal from the Program.
All payments under the Program are made at GhostShorts' sole discretion, acting reasonably and in good faith. While we publish payment rates and structures as guidelines, these are subject to change and do not constitute a guarantee of payment for any specific post.
Ambassadors who are removed from the Program for fraud or rule violations forfeit all unpaid earnings. Ambassadors who voluntarily leave or are removed without cause will receive payment for verified posts within their measurement window, at GhostShorts' discretion.
The following actions constitute fraud and are grounds for immediate and permanent removal from the Program, forfeiture of all unpaid earnings, and potential legal action:
GhostShorts is the sole judge of what constitutes fraud or abuse. Our determination is final and not subject to appeal. We are under no obligation to provide evidence of fraud to the Ambassador.
Right to Clawback: If GhostShorts determines that payments were made based on fraudulent, artificially inflated, or otherwise ineligible impressions, whether discovered at the time of payment or at any point afterward, GhostShorts reserves the right to reclaim those payments in full. This includes deducting overpayments from future earnings, issuing a PayPal payment reversal or dispute, invoicing the Ambassador for the amount owed, or pursuing any other legal remedy available. By participating in the Program, you agree to promptly return any payments that GhostShorts determines were made in error or based on fraudulent activity.
You retain ownership of all content you create under the Program. However, by participating in the Program, you grant GhostShorts a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, distribute, display, and create derivative works from your ambassador content for marketing, promotional, and commercial purposes across any medium. This license survives termination of your participation in the Program.
GhostShorts may feature your content on our website, social media, advertising, or other marketing materials without additional compensation or approval.
You are required to comply with all applicable advertising disclosure laws and regulations, including but not limited to the U.S. Federal Trade Commission (FTC) Endorsement Guides. Every post made under the Program must include a clear and conspicuous disclosure of the material relationship (e.g., #ad, #ambassador, #sponsored, or "paid partnership").
Failure to include proper disclosure is a violation of these Terms. GhostShorts is not responsible for any legal consequences arising from your failure to disclose the partnership.

GhostShorts may request removal of any content that violates these Terms. Failure to remove such content within 48 hours of the request constitutes grounds for immediate removal from the Program.
You agree to indemnify, defend, and hold harmless GhostShorts, its officers, directors, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOSTSHORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE PROGRAM, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST EARNINGS, OR LOSS OF BUSINESS OPPORTUNITY, REGARDLESS OF THE THEORY OF LIABILITY.
GhostShorts' total aggregate liability under these Terms shall not exceed the total amount actually paid to you under the Program in the 90 days preceding the claim.
GhostShorts makes no guarantees about the availability, continuity, or future existence of the Program. The Program is provided "as is" without warranties of any kind.
Participation in the Program does not guarantee any earnings. Payment amounts depend on impression volume, post eligibility, and GhostShorts' sole determination of compliance with these Terms. Published payment rates are guidelines and may change at any time. Past performance or published examples do not guarantee future payouts.
By applying to the Program, you consent to GhostShorts collecting and storing your name, email address, social media profile links, and payment information for the purpose of administering the Program and processing payments. This data will be handled in accordance with our Privacy Policy.
GhostShorts may access publicly available data from your social media profiles (including post metrics, follower counts, and engagement data) for the purpose of verifying post eligibility and impression counts.
You agree not to disclose any non-public information about the Program's internal operations, verification methods, fraud detection processes, or private communications with GhostShorts staff. Payment amounts you personally earn are not considered confidential.
You may not assign, transfer, or delegate your participation in the Program or any rights or obligations under these Terms to any third party without GhostShorts' prior written consent. GhostShorts may assign these Terms at any time without notice.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
In the event of ambiguity in any provision of these Terms, the ambiguous provision shall be interpreted in favor of GhostShorts.
These Terms, together with the Program guidelines document and the GhostShorts Privacy Policy, constitute the entire agreement between you and GhostShorts regarding the Program. These Terms supersede any prior agreements, understandings, or representations, whether written or oral.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
